TERMS, CONDITIONS, & AGREEMENTS
ACKNOWLEDGEMENT OF LIMITATIONS:
Client acknowledges and agrees that Speaking K9 has not represented, promised, guaranteed or warranted that Dog can be trained, that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavioral problems, or that the training will last for any particular amount of time. Client agrees understands and acknowledges that the elimination or modification of behaviors is not guaranteed. The Client further acknowledges that dog training will not provide exact results as each dog is different in regards to ability, breeding and temperament. Client understands and agrees that follow-up and future training is their sole responsibility and that they must contact Speaking K9 to schedule future training sessions.
TERMS AND CONDITIONS:
For good and valuable consideration Speaking K9 will provide the following services: Board and Train: Dog shall be boarded and trained at Speaking K9’s premises or any other location to be determined by Speaking K9. Board and Train services may include a follow-up private lesson, depending on length of Board and Train, that lasts approximately 1 hour focusing on an explanation of the training your dog has received and progress your dog has made. Typically, Speaking K9 will deliver home the dog and have an end meeting lasting approximately 2 hours that focuses on teaching the handler what has been worked on during the board and train (Tell-Show-Do). Arrangements can be made if the client would prefer to pick up their own dog. Speaking K9 will not release the dog to anyone other than authorized persons indicated on the application. In Home Training Sessions: We specialize in coming into your home and training where your dog feels most comfortable upon the foundation that has already been established. Appointments are charged in increments of 30 minutes, minimum of a 1-hour appointment.
PAYMENT:
Client agrees to pay Speaking K9 a fee for services as follows: an in-home training session, the full hour will be charged regardless if the appointment was cut short on client’s behalf. A deposit of 25% of the service scheduled is due minimum of 48 hours before scheduled appointment time. Client agrees to give a cancellation notice of 48 hours prior to scheduled appointment. Client agrees and understands that the 25% deposit is non-refundable within the 48-hour period. Rescheduling appointments will be tolerated once on the client’s behalf. Cancellation from Speaking K9 may occur anytime, with notice and will not be held against you. Mileage fees may occur if you are outside the Ogden, UT area and are due with payment for services.
TERMINATION:
Speaking K9’s services shall terminate if (a) in Speaking K9’s judgment, Dog is dangerous or vicious to Speaking K9 or any other person or animal, or interferes with the training of other dogs without initially being indicated on application that dog has aggressive issues, (b) Client breaches any term or condition of this Agreement or (c) Client requests service termination. Upon termination in accordance with the foregoing, Speaking K9’s duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.
HOLD HARMLESS:
The client will hold Speaking K9 and its associates, including but not limited to, Don’s Pet Care and E-collar technologies free and harmless from any and all claims, liability, damage, loss, misuse of products or expenses arising out of any injury to any person or to any person’s property by the dog(s) named in this contract.
RELEASE OF LIABILITY:
Client understands that Speaking K9 and Don’s Pet Care are facilities that house additional animals and as such will potentially play, eat, interact and sleep around other dogs, and that there are inherent risks associated with dogs boarding in this environment including but not limited to injuries due to normal play, rough play, scuffles, fights and attempts to escape and run away despite Speaking K9’s best efforts to minimize such risks. Client further understands that despite the best care boarded pets are susceptible to and can develop loose stools, severe diarrhea, hot spots, weight loss, weight gain and excessive shedding. Client agrees to fully release from liability Speaking K9 and Don’s Pet Care, should their dog become injured, gets fleas, ticks or worms, becomes pregnant, escapes or runs away, or contracts any malady, illness or disease during or after all services provided by Speaking K9, on or off Speaking K9’s Premises, at Clients Home or Business or any other location including, but not limited to, Don’s Pet Care. Client fully accepts these risks and agrees that Speaking K9 and its associates, including but not limited to, Don’s Pet Care shall not be held responsible for it or any resulting injuries, losses, damages, costs or expenses including but not limited to veterinarian charges or treatments necessary.
PHOTOGRAPHY AND VIDEO RELEASE:
Speaking K9 may photograph or video tape participation of activities from both owner and dog from time to time. For valuable consideration received, you hereby irrevocably grant Speaking K9 perpetually, exclusively, and for all media throughout the world (including print, home-video, CD-ROM, Internet, and any other electronic medium currently present in existence or invented in the future), the right to incorporate (alone or together with other materials), in whole or in part, photographs or video footage taken of you or your dog as a result of yours or your dog’s participation in approved activities of Speaking K9. Speaking K9 holds all rights to photographS and video footage taken while under the care of Speaking K9. You hereby agree that you will not bring or consent to others bringing claims or action against Speaking K9 or its associates including, but not limited to Don’s Pet Care, on the grounds that anything contained in the property, or in the advertising and publicity used in connection herewith, is defamatory, reflects adversely on you, violates any other rights whatsoever, including, without limitations, rights of privacy and publicity. You hereby release Speaking K9 and its associates including, but not limited to Don’s Pet Care, any and all claims, demands, causes and actions, suits, costs, liabilities and damage whatsoever that you may hereafter have against Speaking K9. You understand and agree that there will be no royalties, payments, or any other compensation for photographs or video footage. This agreement has no time limit and is valid and enforceable for any and all future stays for my dog(s) with Speaking K9.
SOLE AGREEMENT:
This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Speaking K9 regarding the matters as described previously. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to the Dog or anything else.
CLIENT AUTHORIZATION:
I have read, acknowledge and agree to all terms, conditions and agreements as set forth previously which represents this entire agreement. My initials and/or signature of application are proof of my acceptance of this entire agreement. I agree to pay promptly, in full and prior to my dogs stay with Speaking K9 and after for any additional incurred charges. I will be solely responsible for payment of any charges incurred for any veterinary care and treatment provided. I further authorize Speaking K9 to charge my credit card if it was provided as payment for services. This agreement has no time limit and is valid and enforceable for any and all future stays for my dog(s) with Speaking K9 unless my information or my dog's information has changed in which case it is my sole responsibility to notify Speaking K9 of any changes. Furthermore, I certify that Dog is in good health and has not been ill with any communicable diseases within the past 30 days. I certify that my dog has not been exposed to Rabies, Distemper, Hepatitis, Leptospirosis, Parainfluenza, Parvovirus, Bordetella (Kennel Cough) Papilloma’s or Conjunctivitis within a 30-day period prior to boarding.
Terms, Conditions and Agreements are subject to change anytime. It will be clients’ responsibility to keep current on all Terms, Conditions and Agreements.
